Welcome
These Terms are written to be clear and fair, not adversarial β we'd always rather resolve any concern directly and generously than rely on the fine print. They set out the basis on which we offer our Services, and the protections you're entitled to. Please read them before booking.
1. Who We Are
These Terms & Conditions ("Terms") govern your use of www.thenirvanist.com (the "Website") and all services offered through it, including Curated Spiritual Journeys, Virtual Satsangs, and The Heal Project (together, the "Services").
The Website and Services are operated by The Nirvanist LLP, a Limited Liability Partnership registered in England and Wales under company number OC460620, with registered office at 128 City Road, London, EC1V 2NX, United Kingdom ("The Nirvanist," "we," "us," "our"). We are an international team and our day-to-day operations are conducted remotely.
By accessing the Website or booking any Service, you ("you," "traveller," "user," "customer") agree to be bound by these Terms. If you do not agree, please do not use the Website or Services.
2. Definitions
- "Spiritual Journey" means any in-person, multi-day experience in India organised, arranged, or facilitated by The Nirvanist, including accommodation, transport, guided programming, and access to teachers or spiritual sites.
- "Supplier" means any independent third party whose services form part of a Spiritual Journey, including accommodation providers, ashrams, transport and logistics operators, local guides, and teachers.
- "Satsang" means any live, online spiritual gathering hosted or facilitated by The Nirvanist.
- "Heal Project" means the mission-driven content and sponsorship initiative at thenirvanist.com/heal.
- "Content" means quotes, articles, audio, video, itineraries, and other material made available through the Website.
3. Eligibility & Accounts
3.1 You must be 18 years or older and have the legal capacity to enter into a binding contract to book a Spiritual Journey or make a payment to us. Satsangs and free Content are not directed at, and should not be used by, children under 16.
3.2 If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately at hello@thenirvanist.com if you suspect unauthorised use.
3.3 We may suspend or close accounts that breach these Terms, are used fraudulently, or are inactive for an extended period, with notice where reasonably possible.
3.4 We may decline, delay, or cancel a booking β including before accepting payment β where we reasonably believe we cannot yet lawfully or safely deliver the Service to you (for example, because we have not yet arranged the protections required for your country of residence, or because of capacity, health, or safety concerns), and will explain why and offer a full refund of any amount already paid in that situation.
4. Our Services
The Nirvanist offers three categories of Service. Each has its own additional terms below, which take precedence over the general terms in case of conflict:

5. Spiritual Journeys β Booking & Travel Terms
5.1 The Nature of What We Sell
Spiritual Journeys typically combine accommodation, in-country transport, and curated programming (access to teachers, ashrams, and structured learning) presented together at the point of booking.
5.2 Your Financial Protection
Where you book a Spiritual Journey as a resident of the United Kingdom or the European Economic Area, your booking is treated as a package under the UK Package Travel and Linked Travel Arrangements Regulations 2018 and/or the EU Package Travel Directive (2015/2302), and you receive the protections those rules provide, including:
- Insolvency protection for the money you pay us, so that if The Nirvanist were to become insolvent, your payments are protected and, where you are already travelling, your return is covered. The name and contact details of our insolvency protection provider are given to you in your booking documentation.
- A Standard Information Form and the required pre-contractual information (your itinerary, accommodation standard, total price, and cancellation terms), provided before your booking is confirmed.
- Organiser responsibility for the proper performance of the travel services in your package, as described in Section 5.13.
These protections are an important part of how we look after you, and we're glad to provide them.
5.3 Where These Protections Apply
The insolvency protection, Standard Information Form, and organiser responsibility described above apply where you are resident in the United Kingdom or the European Economic Area at the time of booking, as required by the Package Travel and Linked Travel Arrangements Regulations 2018 and/or the EU Package Travel Directive (2015/2302) respectively. Where the law of your country of residence imposes additional or different requirements, we will comply with those instead, or in addition, as applicable.
If you are resident outside the UK/EEA, your booking is governed by the rest of these Terms except for those UK/EEA-specific commitments; in that case, our liability to you is governed by the general Limitation of Liability in Section 12, alongside the other protections in this Section 5. We set this out precisely because these particular commitments are tied to your place of residence β we'd rather be clear than imply a protection that may not apply to you.
5.4 Booking, Price & Payment
The price of each Spiritual Journey is stated on the relevant itinerary page or quote, and may vary by departure date, room configuration, and group size. Prices are quoted in USD (and may also be shown in EUR).
To confirm your place, we ask for payment in full at the time of booking, together with your completed booking form or online confirmation. Your booking is confirmed once we receive both.
We ask for payment upfront because we begin securing your accommodation, transport, and on-the-ground arrangements with our India partners as soon as you book β and, as explained in Section 5.5 below, the larger part of what you pay is passed straight to those partners to hold your place. Your cancellation rights are set out in Section 5.8, and we recommend comprehensive travel insurance from the moment you book (Section 5.9).
5.5 How We Price Your Journey
Our price for a Spiritual Journey is made up of two parts:
- A Design Fee β our fixed fee covering the curriculum, teacher access, curation, content, and on-the-ground coordination we provide. This is our only source of profit on a Spiritual Journey.
- A Reservation Amount β the actual cost of accommodation, local transport, and other Supplier services in your itinerary. We arrange these services as your agent, passing the cost on at no markup and remitting it to Suppliers as we receive payment.
This pricing structure reflects how we run our business β we earn only our Design Fee and don't profit from your accommodation or transport. For travellers resident in the UK or EEA, it does not reduce the organiser responsibilities described in Sections 5.2 and 5.13.
5.6 What's Included / Not Included
Each itinerary page specifies what is included (e.g., accommodation, listed meals, in-country transport, programming access) and what is not (e.g., international flights, visas, travel insurance, personal spending, tips). Please read the specific itinerary carefully β inclusions vary by journey.
5.7 Changes We Make
Spiritual programming in India sometimes depends on the availability of teachers, ashrams, and local conditions beyond our control. Where we need to change a meaningful element of your itinerary, we will always try to substitute a comparable experience of equivalent or better quality and let you know as soon as reasonably possible. If we have to make a significant change β for example a change of destination or dates, or a price increase of more than 8% β you may accept the change, accept a suitable alternative we offer, or cancel and receive a refund of amounts paid for the affected Service that we are able to recover, in line with Section 5.8. (The 8% figure reflects the threshold in the Package Travel Regulations and applies to all travellers as a matter of our policy.)
5.8 Cancellation by You
We've designed our cancellation terms to be as fair as the realities of arranging travel in India allow, and they reflect the two parts of your price (see Section 5.5):
Your Design Fee β generously refundable. If you cancel 15 or more days before departure, we refund 100% of your Design Fee. We're glad to do this: it's our own fee, and we'd rather you felt free to book than worried about losing our portion. For cancellations within 15 days of departure, the Design Fee is non-refundable, as the curation, planning, and preparation it pays for are by then largely delivered.
Your Reservation Amount (supplier cost) β retained as a cancellation fee to the extent already committed. As soon as you book, we commit and remit your accommodation, transport, and other supplier costs to our India partners to hold your place. Because Indian foreign-exchange rules make reversing these payments slow, costly, or impossible, any part of the Reservation Amount we have already committed or remitted is retained as a cancellation fee, as it represents a genuine cost we cannot recover. Where we are able to recover any portion from a Supplier, we refund that portion to you promptly.
This is why we strongly recommend comprehensive travel insurance (Section 5.9): a good policy reimburses cancellation for covered reasons such as illness or emergency, which our Supplier commitments cannot. Insurance β not our cancellation terms β is the right protection when your circumstances change.
If you are resident in the UK or EEA: the Package Travel Regulations give you the right to cancel before departure against a reasonable cancellation fee. The terms above are intended to operate as that reasonable fee β they reflect the genuine costs we cannot recover and the value of work already done, not a penalty. Where the law would require us to refund more in your specific circumstances, we will; you always receive at least what the law requires, and we'll set out any fee transparently.
5.9 Travel Insurance
We strongly recommend you take out comprehensive travel insurance as soon as you book, covering at least trip cancellation and curtailment, medical emergencies and evacuation, and repatriation. Given that parts of a Spiritual Journey take place in remote locations, and given our cancellation terms above, appropriate insurance is the sensible way to protect yourself against the unexpected. It is your responsibility to ensure your policy is adequate for your circumstances and the activities involved.
5.10 Cancellation by Us
Occasionally we may have to cancel a Spiritual Journey β for example because too few travellers have booked, or because of circumstances beyond our control affecting safety or feasibility (such as natural disaster, serious unrest, pandemic, or government advisory). If this happens, we will offer you the option to transfer to a future departure at no extra Design Fee, which we hope will usually be the welcome outcome. Where you would rather not transfer, we will refund the amounts you have paid that we are able to recover, and β for travellers resident in the UK or EEA β at least the refund the Package Travel Regulations require, within the timeframe they require.
Because you arrange your own international flights and any other services you book independently of us, those are outside our control and we are not responsible for them; we recommend booking flexible or refundable flights, or relying on your travel insurance, to protect against this. We are not liable for costs of services you booked separately, except to the extent applicable law requires.
5.11 Health, Fitness & Assumption of Risk
Spiritual Journeys involve travel to remote and sometimes high-altitude locations, extended periods of sitting, walking on uneven terrain, and participation in physical and meditative practices.
You are responsible for deciding whether a Spiritual Journey is suitable for you. Before booking, please satisfy yourself β taking your own medical advice where appropriate β that you are fit to participate. It is your responsibility to disclose to us, in advance, any health conditions, allergies, dietary needs, or mobility requirements relevant to your participation, so that we can share what we reasonably can with relevant Suppliers and respond appropriately in an emergency. We will use reasonable efforts to accommodate disclosed needs, but we do not warrant that every condition or requirement can be accommodated in the locations visited, and we may decline participation where we reasonably believe we cannot do so safely.
Nothing in our programming is a substitute for medical, psychiatric, or psychological treatment, and our facilitators, guides, and teachers are not medical professionals and do not provide medical advice. You participate in all activities and practices voluntarily and at your own discretion, accepting the ordinary risks inherent in travel and in the activities involved. Nothing in this clause limits our liability for death or personal injury caused by our own negligence, or any other liability that cannot be excluded under applicable law.
5.12 Travel Documents, Visas & Vaccinations
You are responsible for ensuring you hold a valid passport, any required visa for India, and any recommended vaccinations, and for checking official government travel advice for your nationality before departure. We can offer general guidance but cannot guarantee entry requirements, which can change without notice.
5.13 Suppliers & Third-Party Services
Accommodation, ashrams, transport, local guides, teachers, and other services within a Spiritual Journey are provided by independent Suppliers, not by The Nirvanist. We select our Suppliers with care, but we do not own or control them.
General position (all travellers). Except as stated in the UK/EEA paragraph below, The Nirvanist's role is to design, curate, and coordinate your journey and to arrange these Supplier services on your behalf. Each Supplier is responsible for the services it provides and for its own acts, omissions, and standards. To the fullest extent permitted by applicable law, The Nirvanist is not liable for loss, injury, delay, or damage caused by a Supplier or by any act or omission of a Supplier, and your claim in respect of a Supplier's service lies against that Supplier. Nothing in this paragraph excludes our liability for our own negligence, for death or personal injury caused by our negligence, or any liability that cannot be excluded under applicable law.
If you are resident in the UK or EEA: the Package Travel Regulations require us, as organiser, to accept responsibility for the proper performance of the travel services included in your package, including those carried out by Suppliers. Where a service falls short, the usual remedy is that we put it right, or β where we can't β provide a price reduction proportionate to the part of the service affected; compensation for any further loss is available only where the Regulations require it, and is subject to the limits in Section 12. This responsibility does not apply where the shortfall is attributable to you, to a third party unconnected with the travel services where it was unforeseeable or unavoidable, or to unavoidable and extraordinary circumstances. Where Suppliers' own international conventions limit the compensation they must pay, the same limits apply to us. This paragraph prevails over the general position above where it gives you greater protection.
5.14 Complaints
If something goes wrong during a Spiritual Journey, please tell us as soon as possible β in person, through the contact details provided in your trip documentation, or at hello@thenirvanist.com β so we have the chance to put it right while you're still travelling. Written complaints after the trip should be sent to hello@thenirvanist.com within 30 days of your return.
6. Virtual Satsangs
6.1 Satsangs are live online gatherings centred on curated spiritual content, accessed via a link provided after registration. We try to ensure stability but cannot guarantee uninterrupted streaming, and are not liable for issues caused by your internet connection, device, or third-party platforms.
6.2 Satsangs are currently offered free of charge, supported by voluntary contributions and sponsorship. We may, at our sole discretion and with notice, introduce charges for some or all Satsangs or related offerings in future. Attending a free Satsang now does not entitle you to free access to any future or paid offering.
6.3 Recording. Satsang sessions may be recorded for archival, community, and promotional purposes. By joining a Satsang, you consent to being recorded, including any audio, video, or chat contributions you make while attending. If you prefer not to appear, you are welcome to keep your camera and microphone off and refrain from posting in the chat.
6.4 Content shown during Satsangs. From time to time we present publicly available third-party material (such as talks or recordings) that is relevant to the session's theme, for educational and non-commercial community discussion. We do not claim ownership of, or rights in, any such third-party material, and we attribute it where we can. If you are a rights-holder and would like material removed, contact us at hello@thenirvanist.com and we will act promptly.
6.5 We may change, reschedule, or cancel any Satsang, including the content presented, at any time and without prior notice.
6.6 Satsangs are offered for spiritual reflection and community connection. They are not therapy, counselling, or medical advice, and you should consult an appropriately qualified professional for any health or mental health concern.
7. The Heal Project
7.1 The Heal Project amplifies the wisdom of spiritual leaders through sponsor-funded content distribution. We take no commission on sponsorships; any voluntary tips offered by users support the Project's operating costs.
7.2 We display amplification metrics (reach, country-level results) in good faith based on the data available to us from our distribution partners, but we do not guarantee specific outcomes, reach figures, or engagement levels for any sponsorship.
7.3 Sponsoring or supporting the Heal Project does not constitute endorsement by The Nirvanist of any sponsor's other products, services, religious affiliation, or political views, and vice versa.
7.4 Tips are voluntary contributions, not payment for a specific service, and are non-refundable except where required by law.
8. Payments & Pricing
8.1 Card payments are processed via Stripe; bank transfer payments are made directly to the local-currency account details provided via Wise. We do not store your full card details.
8.2 All prices are quoted in the currency shown at checkout. You are responsible for any currency conversion fees charged by your bank or card issuer.
8.3 Taxes. Prices are exclusive of VAT and any other applicable taxes, which will be added where required by the law of the relevant jurisdiction. Where we are obliged to charge VAT or other taxes, this will be reflected at checkout or on your invoice.
9. Content, Intellectual Property & User Submissions
9.1 The Website's original content β including our own articles, itineraries, curated learning materials, photography, design, and branding (the "Nirvanist Materials") β is owned by The Nirvanist and protected by copyright and other rights. You may share Nirvanist Materials for personal, non-commercial purposes (for example, the share buttons on quote cards), but you may not reproduce, sell, or commercially redistribute them without our written permission.
9.2 Some Website content β including quotes, talks, and other material attributed to teachers, authors, or third parties β is not owned by us. It remains the property of its respective rights-holders, and we present it in good faith for educational, devotional, and non-commercial purposes, with attribution where we can. We claim no ownership of such material and will promptly remove any item at the rights-holder's reasonable request (contact hello@thenirvanist.com).
9.3 If you submit a testimonial, photo, video, or other content to us (e.g., for the testimonials page), you grant The Nirvanist a non-exclusive, worldwide, royalty-free licence to use, edit, translate, and publish it across our Website and marketing channels, unless you tell us otherwise in writing. You confirm you have the right to grant this licence and that your submission is accurate.
9.4 We may photograph or record group moments during a Spiritual Journey or Satsang for archival, community, and marketing purposes, and by participating you consent to this. If you would prefer not to appear in published material, let us know in writing and we will make reasonable efforts to honour that.
10. Acceptable Use
You agree not to use the Website to: (a) violate any law; (b) harass, defame, or harm another person or group; (c) impersonate any person or entity; (d) upload malicious code; (e) scrape or systematically extract Content without permission; or (f) misuse the booking or payment systems. We may suspend access for any breach of this section.
11. Spiritual Content Disclaimer
The Nirvanist shares teachings, practices, and perspectives drawn from Indian spiritual traditions, presented with respect for their lineage and context. Our Content and Services are offered for educational, reflective, and experiential purposes. They are not medical, psychological, legal, or financial advice, and engaging with any practice, teacher, or journey is a personal choice made at your own discretion. We respect diverse beliefs and do not present any single path as superior to another, including practices you may already maintain at home.
12. Limitation of Liability
12.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under English law.
12.2 Subject to clause 12.1 and to Section 5 (where the Package Travel Regulations apply), our total liability to you arising from these Terms or your use of the Services is limited to the amount you paid for the relevant Service.
12.3 We are not liable for indirect or consequential losses, including loss of enjoyment, loss of profits, or losses arising from events outside our reasonable control.
12.4 Scope of this section. This Section 12 is the default position for all customers. Where you are resident in the UK or EEA, the organiser responsibility and financial protection described in Section 5 (in particular 5.2 and 5.13) apply in addition to, or instead of, clause 12.2 as required by law. For all other customers, this Section 12 governs in full, alongside the general protections of Section 5 that aren't tied to UK/EEA residence.
12.5 Nothing in this Section 12 limits any liability, or removes any right, that cannot lawfully be limited or removed under the law of your country of residence.
13. Indemnity
You agree to indemnify The Nirvanist against reasonable losses, costs, or claims arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right β except to the extent caused by our own breach or negligence.
14. Termination
We may suspend or terminate your access to the Website or a booking if you materially breach these Terms, subject to giving you reasonable notice and an opportunity to remedy the breach where appropriate (this does not affect Sections 5.8 and 5.10, which set out the specific cancellation/refund terms for Spiritual Journeys).
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services or the law. The version in force at the time you book a Service or use the Website will apply. We'll post the "last updated" date at the top of this page; for material changes affecting an existing Spiritual Journey booking, we'll contact you directly.
16. Governing Law & Dispute Resolution
16.1 These Terms are governed by the laws of England and Wales, without prejudice to clause 16.2.
16.2 If you are a consumer resident in the UK, EU, or another jurisdiction with mandatory consumer protections, nothing in these Terms deprives you of protections you're entitled to under the mandatory laws of your country of residence, and you may bring proceedings in the courts of England and Wales or, where the applicable law allows, in the courts of your country of residence.
16.3 Force majeure: Neither party is liable for failure to perform obligations caused by events beyond reasonable control (e.g., natural disaster, pandemic, war, government action, strikes).
16.4 We aim to resolve any complaint directly and amicably. If you are an EU consumer, you may also use the European Online Dispute Resolution platform; if you are a UK consumer, an alternative dispute resolution scheme may be available, and we will tell you about any scheme we are a member of.
17. General
- Severability: if any clause is found unenforceable, the rest of these Terms remain in effect.
- No waiver: failing to enforce a term on one occasion doesn't waive our right to enforce it later.
- Assignment: you may not transfer your rights under these Terms without our consent; we may assign our rights in connection with a merger, sale, or restructuring.
- Entire agreement: these Terms, together with any specific itinerary or booking confirmation, form the entire agreement between us regarding the Services. Each party confirms it has not relied on any representation, promise, or statement that isn't written into these Terms, the relevant itinerary, or our written correspondence with you β except that nothing in this clause limits liability for fraud or fraudulent misrepresentation.
- Notices: we may communicate with you by email to the address on your account or booking; please keep this up to date.
- Time limit on claims: please raise any complaint about a Spiritual Journey within the timeframes in Section 5.14 so we can address it quickly. Except where the law of your country of residence gives you a longer period (which always prevails), any legal claim arising from the Services should be brought within one year of the date you became aware, or ought reasonably to have become aware, of the matter giving rise to it.
